dc.description.abstractEn este documento se analizan los regímenes de la inversión extranjera directa (IED); y los marcos legales e institucionales ambientales que rigen a este tipo de inversiones en México y Chile, incluyendo las regulaciones que respecto de la IED y el medio ambiente establecen tanto el Tratado de Libre Comercio de América del Norte (TLCAN); como los TLC suscritos por Chile. México y Chile emprendieron profundos procesos de liberalización económica que se tradujeron, entre otras cosas, en la eliminación de restricciones a la IED y la desregulación de los procedimientos para su internación, rubro en el que alcanzaron niveles de apertura notables que los convirtieron en dos de los casos más exitosos de atracción de IED en América Latina. En este contexto, la suscripción de tratados de libre comercio fue un factor clave que facilitó el ingreso de cuantiosos flujos de capital. Al abordar los esquemas normativos ambientales de la IED, que representan el mecanismo para regular sus efectos sobre el medio ambiente, cabe acotar que los marcos legales e institucionales ambientales de México y Chile, a pesar de que registran distintos niveles de evolución y adolecen todavía de falencias significativas, han experimentado avances. Al respecto, es necesario subrayar el aporte que la suscripción de los TLC significó para estos progresos. Tanto en México como en Chile se coincide en afirmar que las industrias con componente de IED han sido más efectivas en el cumplimiento de las regulaciones ambientales. Sin embargo, más que atender a la procedencia de la inversión, el cabal cumplimiento de criterios ambientales en la industria depende del establecimiento de una legislación ambiental más severa y de una mayor capacidad institucional de los países para exigir su observancia. The regimens of foreign direct investment and their environmental regulation in Mexico and Chile Abstract: This report analyses the pattern of foreign direct investment and the legal and institutional framework that regulate this type of investment in Mexico and Chile, including regulations on  FDI and environmental issues, established in the North American Free Trade Agreement (NAFTA); and the Free Trade Agreements signed by Chile.Mexico and Chile have begun an intense process of economic liberalization that is reflected in, among other things, the elimination of restrictions on FDI and deregulation of the process of admission. The substantial level of economic openness of these two countries has converted them into the two most successful cases in Latin America for attracting Foreign Direct Investment. It can thus be concluded that the signing of free trade agreements was a key factor for enabling a substantial capital influx. When approaching the subject of the environmental norms of FDI, which represent the mechanism for regulating its effects on the environment, it is necessary to explain the implications of the legal and institutional framework of Mexico and Chile. Despite the fact that these countries present different levels of evolution and still suffer from significant failures, they have experienced advances. The signing of Free Trade Agreements has had a significant role in this progress. As such, it becomes necessary to emphasize the significant role that the signing of Free Trade Agreements have had on this progress. Mexico and Chile agree that the industries that hold a FDI component have been the most effective in complying with environmental regulation. However, rather than just focusing on the origin of investment, a satisfactory fulfillment of environmental criteria in the industry requires an establishment of stricter environmental legislation with greater institutional capacity in the countries for demanding compliance.
