dc.description.abstractEngThe Committee to Support Implementation and Compliance of the Regional Agreement on Access to Information, Public Participation and Justice in Environmental Matters in Latin America and the Caribbean (Escazú Agreement) held its first periodic consultation and dialogue with Saint Lucia during a visit to the country on 3 and 4 April 2025. The parties agreed on the following list of topics for consideration in the dialogue: (i) public participation in the decision-making process for projects and activities that have or may have a significant impact on the environment; and (ii) access to justice in environmental matters, with a particular focus on means to publicize the right of access to justice and the procedures to ensure its effectiveness. On that basis, the Committee notes that Saint Lucia has general legislation regulating the environmental impact assessment (EIA) process, as well as mechanisms to facilitate access to justice. The Committee recognizes recent regulatory progress in promoting public participation in EIA processes to ensure effective mechanisms for public engagement in projects and activities, and initiatives taken by the judiciary to educate the public and make justice more accessible to citizens. However, challenges remain. Regarding public participation, challenges include: enhancing public information mechanisms for EIA processes by ensuring that information is accessible, effectively disseminated and made available within adequate time frames to enable meaningful public engagement; strengthening the role of the authority responsible for overseeing public participation in EIAs; improving inter-institutional coordination; and building human, technical and financial capacities to ensure the effectiveness of public participation mechanisms. Regarding access to justice, challenges include: expanding judicial training on environmental matters; promoting the publication and dissemination of judicial decisions in clear and accessible language; reducing or eliminating prohibitive legal costs and expanding legal standing criteria; and improving access to specialized legal and technical assistance on environmental matters, in particular for persons and groups in vulnerable situations.
