dc.description.abstractEl presente documento expone una aproximación a las condiciones generales de competencia en Guatemala. Se pretende, por una parte, esbozar un mapa con la historia y la situación actual de las políticas de competencia en Guatemala, entendidas como las acciones del gobierno encaminadas a proteger e incentivar la libre competencia en los mercados. Por otra parte, se presenta una evaluación preliminar de la situación de competencia en cinco sectores económicos seleccionados por su importancia para la economía nacional y por las condiciones particulares de su estructura.En el estudio se destaca la precaria institucionalidad para la promoción y defensa de la competencia, evidente en la existencia de leyes dispersas que pretenden promover algunos aspectos de la libre competencia, pero que en la práctica se han vuelto inoperantes. Esto contrasta con el avance en términos de apertura de mercado, registrado en sectores liberalizados recientemente como telecomunicaciones y electricidad. Los sectores analizados presentan características de integración horizontal y vertical, así como de concentración del poder de mercado, que resultan en estructuras oligopolistas propicias para ejercer prácticas de comercio desleal y de abuso de posición de dominio. Finalmente, se evidencia en el trabajo la importancia que las empresas multinacionales están adquiriendo en diversos sectores del país y del resto de Centroamérica. Esto genera retos muy particulares relacionados con la promoción de la competencia en los mercados locales y regionales. General conditions of competition in Guatemala Abstract: This report evaluates the general conditions of competition in Guatemala. As such, it presents an outline of the historical evolution and current situation of the policies of competition in Guatemala understood as governmental actions aimed at protecting and providing incentive for free competition of the markets. Additionally, the report presents a preliminary evaluation of the situation of competition in economic sectors selected for their important role in the national economy and the particular conditions of their structure. The study places focus on the weak institutional framework for promoting and protecting competition, illustrated by the existence of disperse laws that attempt to promote certain aspects of free competition but in practice have been rendered ineffective. This contrasts the advancement in terms of market aperture, registered in recently liberalized sectors such as telecommunications and electricity.The analyzed sectors present characteristics of horizontal and vertical integration, such as concentration of market power, which has resulted in oligopoly structures, which enable those involved to exercise unfair trade practices and abuse their dominating position.Finally, the report presents evidence over the important role multinational companies in several sectors in the country and the rest of Central America. This generates particular challenges related to promoting competition in local and regional markets.
